Overview
The Data Privacy Counsel serves as Tech Data's legal in-house subject matter expert and primary attorney, providing legal advice regarding a broad range of global data privacy issues. The Data Privacy Counsel will partner with senior leaders and influence cross-functionally to continue to develop and manage the global privacy program, oversee the information management program and be responsible for data use innovation and compliance with global data protection and privacy regulations. Data Privacy Counsel will partner with the CLO, CIO, CHRO, CECO and other executives to drive Tech Data Corporation's data stewardship vision. The Data Privacy Counsel will advise on day-to-day privacy compliance with regional privacy laws, and help manage compliance with Tech Data's global Privacy and Information Management programs. Reporting into the Tech Data's General Counsel the individual filling the position will work closely with other members of Tech Data's Legal, Ethics and Compliance, HR, and IT Security Departments.
Essential Duties & Responsibilities Required
Serve as lead privacy counsel to global functions in connection with business activities
Be a leader in the strategy and implementation of the company's global Privacy, Data Protection and Information Management policies
Provide advice on international privacy laws concerning cross border personal data transfers associated with employment matters and business transactions to ensure compliance with all applicable legal and regulatory requirements
Review, draft and negotiate privacy and data protection contract terms
Review data collection and use practices to ensure consistency and legal compliance
Maintain and monitor the organization's global privacy requirement landscape and related procedures, data transfer requirements, notice and consent obligations and any other data collection requirements
Coordinate with the Records and Information Management Program Manager to advise on appropriate handling, storing, transfer, retention and destruction of records and data
Be a leader in the conduct of data privacy risk assessments and direct the development and implementation of data privacy risk mitigation activities
Work with management and key stakeholder groups and committees to ensure Tech Data has and maintains appropriate data privacy consents reflecting current organization practices and legal requirements
Provide guidance regarding notification, disclosure and other legal obligations in connection with data security/privacy incidents and data privacy incident response programs
Serve as Tech Data's liaison to regulatory agencies regarding data privacy matters
Oversee delivery of data privacy training to facilitate and promote data privacy awareness within Tech Data and related entities
Perform legal research and analysis on data privacy issues related to Tech Data and its subsidiaries' businesses; identify legal risks and develop compliant recommendations for such risks
Provide legal opinions and solutions for various issues or questions raised by the operational areas
Keep abreast of legal developments within designated subject matter and assist in the design and implementation of appropriate processes and policies
Provide practical and solution-oriented legal advice to business leaders
Analyze existing and developing Tech Data programs and solutions to ensure they comply with applicable privacy and data protection laws and industry best practices
Draft privacy statements, enhanced notices and other disclosures, as needed
Work directly with business units, advising on all privacy and related regulatory issues

Required Educational and Language skills:
Juris Doctorate Degree from ABA accredited law school or similar European qualifications
Qualified, in good standing and admitted to the practice of law in a state, Florida preferred
Fluency in written and spoken English
Knowledge of additional languages a plus
Previous Experience (Years & Type):
At least 5 years of experience in a role focused on data privacy law in a multinational company, top law firm or regulator and in a matrixed environment is required
Knowledge and proven track record of building and maintaining data privacy compliance programs and controls is required
Deep substantive knowledge of US, EU and other global privacy laws, including GDPR, Privacy Shield, PIPEDA, FTC Act/Section 5
Certifications:
Certified Information Privacy Professional accreditation preferred

Location of position is Clearwater, Florida or in European Office location. Other locations considered.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
